What is Nonconsensual Sexual Contact?
Any physical contact with another person of a sexual nature without the person’s consent. It includes but is not limited to touching (or penetrating) of a person’s intimate parts (such as genitalia, groin, breasts, or buttocks); touching (or penetrating) a person with one’s own intimate parts; or forcing a person to touch his or her own or another person’s intimate parts.
What Should You Do If You Have Experienced Nonconsensual Sexual Contact?

Find Safety
If you are in immediate danger, find a safe environment and seek help by contacting any of the following sources:

Preserve the Evidence
If you have experienced an incident of nonconsensual sexual contact, do your best to preserve the evidence. You may not remember all aspects of the assault, but there may still be evidence. Do not shower, wash, brush your teeth, douche or change your clothes, as valuable evidence could be destroyed if you do. If you change clothes, place all clothing that you wore during the incident into individual paper bags, not plastic. If you think you were given a drug before or during the assault, try not to urinate before providing any urine samples. If possible, collect any containers from which you drank. These sources of evidence could be important should you decide to file a report and/or press charges. Ideally, this evidence will need to be collected within the first 72 hours after the assault.

Get Medical Attention
If you have suffered less serious injuries that do not require immediate medical attention, consider contacting KSU Student Health Services. Any information you provide about nonconsensual sexual contact will be treated confidentially.

Make A Complaint/File a Report
Complaints of an alleged incident of nonconsensual sexual contact can be made to a number of KSU offices. You can also report an alleged incident of nonconsensual sexual contact to the KSU Department of Public Safety and University Police and the Cobb County Police. Please note that all reports of nonconsensual sexual contact to any of these offices will be investigated. These are non-confidential sources. Regardless of where you report, the university will coordinate its investigation.
A student who is under the influence of alcohol or drugs at the time of an alleged sexual assault should not be reluctant to seek assistance. Disciplinary violations against a student (or against a witness) for personal use of alcohol or drugs will not be enforced if the student is making a good faith report of nonconsensual sexual contact.
No person shall be subject to coercion or reprisal for action taken in good faith to seek advice concerning a sexual misconduct complaint, to file a complaint, or to serve as a witness, panel member, or representative in the investigation of a complaint. Acts or threats of retaliation are a violation of University policy and will be investigated and addressed accordingly.

KSU Office of Institutional Equity/Title IX Coordinator
The Office of Institutional Equity/Title IX Coordinator is responsible for ensuring that KSU complies with all applicable laws and policies regarding discrimination on the basis of race, sex, gender identity, sexual orientation, ethnicity or national origin, religion, age, genetic information, disability or veteran status. The office investigates complaints of unlawful discrimination and harassment, including sexual harassment and sexual misconduct. The office functions as a neutral party in investigating complaints and takes steps to fairly address and resolve such matters.
